This website is operated by Neosurf Africa SARL, a company incorporated under Senegalese law with its registered office at MERMOZ ECOLE POLICE LOT 14 A VDN, Dakar, Senegal, registered under RCCM number SN DKR 2016 B 1951 and NINEA number 005789344 ("Neosurf Africa", "we", "us", "our"). Neosurf Africa offers this website, including all information, tools and services available from this site, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these terms and conditions of use and sale (the "Terms"). These Terms apply to all users of the site. Please read them carefully before accessing or using the website. If you do not agree to all the Terms, you may not access the website or use any services.

Section 1 — Online store terms

By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence. You may not use our products for any illegal or unauthorized purpose, nor may you, in using the Service, violate any laws in your jurisdiction. You must not transmit any worms or viruses or any code of a destructive nature. A breach of any of the Terms will result in immediate termination of your Services.

Section 2 — General conditions

We reserve the right to refuse service to anyone at any time. You understand that your content (excluding payment information) may be transferred unencrypted and involve transmissions over various networks. Payment information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission.

Section 3 — Accuracy, completeness and timeliness of information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting more accurate, complete or timely sources. Any reliance on the material on this site is at your own risk.

Section 4 — Description and provision of the service (vouchers)

Neosurf Africa enables its users to purchase vouchers (prepaid codes) online and to top up mobile wallets. A voucher is a prepaid means of payment represented by a single-use PIN code, usable at partner merchants accepting Neosurf. The voucher is treated as cash: its value is released as soon as the PIN code is disclosed.

The Customer must hold a verified account (phone number validated by OTP code and, where applicable, identity and address documents). Once payment is validated by our payment provider (PayDunya or other), the PIN code is generated and delivered on screen, by email and/or SMS, depending on the selected option. Delivery is generally instant; in the event of network latency, it occurs as soon as payment is confirmed by our servers. Amounts are denominated in FCFA (XOF) unless otherwise stated; any applicable fees (SMS fees, processing fees) are displayed before the order is confirmed.

Section 5 — Cancellation and refund conditions

Cancellation period: an order may only be cancelled as long as the PIN code has not been issued. Once the code has been generated and disclosed to the Customer, the sale is firm and final.

Fees and penalties: no penalty applies to a cancellation made before the code is issued. No cancellation is possible after issuance, except by decision of a competent authority.

Refunds: vouchers are non-refundable once delivered, as they are treated as cash. A refund may only occur (i) where payment has been charged but the code has not been issued, or (ii) at the request of a judicial authority or law enforcement in connection with proven fraud or criminal activity. Where applicable, the refund is made using the same payment method used for the purchase.

Section 6 — Claims conditions

Any claim must be sent to [email protected] within thirty (30) days of the transaction, stating the transaction identifier and any relevant supporting evidence (proof of payment). We acknowledge receipt and process claims within a reasonable time, generally within seven (7) business days.

Section 7 — Modifications to the service and prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part thereof) without notice. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service. Changes to these Terms take effect upon publication on the website.

Section 8 — Products or services

Certain products or services may be available exclusively online and in limited quantities. We have made every effort to display the characteristics of our products as accurately as possible. We reserve the right to limit the sales of our products or services to any person, geographic region or jurisdiction, and to limit quantities. We do not warrant that the quality of any products or services will meet your expectations.

Section 9 — Accuracy of billing and account information

We reserve the right to refuse any order. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. You agree to provide current, complete and accurate purchase and account information, and to promptly update it so that we can complete your transactions and contact you as needed.

Section 10 — Optional tools

We may provide you with access to third-party tools which we neither monitor nor control. You acknowledge that such tools are provided "as is" and "as available" without any warranties. Any use of optional tools is entirely at your own risk.

Section 11 — Third-party links

Certain content, products and services available via our Service may include materials from third parties. Third-party links may direct you to websites that are not affiliated with us. We are not responsible for examining or evaluating their content and assume no liability for any third-party materials, products or services.

Section 12 — User comments, feedback and other submissions

If you send us ideas, suggestions or other materials ("comments"), you agree that we may, at any time and without restriction, use them. We are under no obligation to keep comments in confidence, pay compensation, or respond to them. You are solely responsible for any comments you make and their accuracy.

Section 13 — Personal information

Your submission of personal information through the site is governed by our Privacy Policy.

Section 14 — Errors, inaccuracies and omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions or availability. We reserve the right to correct any errors and to change or update information, or cancel orders, at any time without prior notice.

Section 15 — Prohibited uses

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any regulations or laws; (d) to infringe our or others' intellectual property rights; (e) to harass, abuse or discriminate; (f) to submit false or misleading information; (g) to upload viruses or malicious code; (h) to collect others' personal information; (i) to spam, phish or scrape; (j) for any obscene or immoral purpose; or (k) to circumvent the security features of the Service. We reserve the right to terminate your use for violating any prohibited use.

Section 16 — Responsibility for voucher use

The Customer is solely and entirely responsible for the use, safekeeping and confidentiality of their vouchers and PIN codes. A PIN code is equivalent to cash: anyone in possession of the code can use it. Neosurf Africa cannot be held liable for the loss, theft, sharing or unauthorised use of a PIN code by a third party. In the event of fraudulent, unlawful or non-compliant use (money laundering, fraud, financing of illicit activities, etc.), the Customer assumes full responsibility and may face account suspension, cancellation of transactions and possible legal action, Neosurf Africa reserving the right to cooperate with the competent authorities.

Section 17 — Disclaimer of warranties; limitation of liability

We do not guarantee that your use of the Service will be uninterrupted, secure or error-free. The Service and all products delivered to you are provided "as is" and "as available". In no case shall Neosurf Africa, its directors, employees or service providers be liable for any direct or indirect, incidental or consequential damages arising from your use of the Service or any product. Our liability shall be limited to the maximum extent permitted by law.

Section 18 — Indemnification

You agree to indemnify, defend and hold harmless Neosurf Africa and its affiliates, officers, agents and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

Section 19 — Severability

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed without affecting the validity of the remaining provisions.

Section 20 — Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement. These Terms are effective unless and until terminated by either you or us. If you fail, or we suspect that you have failed, to comply with any provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to the date of termination.

Section 21 — Entire agreement

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right. These Terms constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements.

Section 22 — Governing law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Senegal, and the courts of Dakar (Senegal) shall have exclusive jurisdiction.

You can review the most current version of the Terms at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically. Your continued use of the site following the posting of any changes constitutes acceptance of those changes.

Section 24 — Third-party related terms and conditions

We partner with multiple third-party providers (notably PayDunya for payment processing and the Neosurf network for voucher issuance and acceptance) who may have full or partial access to our information systems. By using the services offered on this platform, you also agree to the applicable terms of these providers.
